When filing for divorce through the court, an important issue is determining which court will consider the case. As a general rule established by Article 27 of the Civil Procedure Code of Ukraine, a claim must be filed with the court at the place of residence or location of the defendant.
However, in practice there are situations where filing a divorce claim at the defendant’s place of residence is difficult or impossible.
When It Becomes Necessary to Choose Another Court
The need to choose another court for divorce proceedings most often arises in the following situations:

the defendant lives abroad;
-
the defendant’s place of residence in Ukraine is unknown;
-
the spouses actually live in another region;
-
the parties prefer to have the case heard in a different court.
In such situations, the law allows the spouses to agree on the territorial jurisdiction of the case.
Divorce by Agreement on Jurisdiction
According to Article 28(2) of the Civil Procedure Code of Ukraine, spouses may agree that the divorce case will be considered by a court at the place of residence or registration of either spouse.
This option allows the parties to choose the most convenient court and avoid additional complications related to territorial jurisdiction.
In practice, such an agreement is usually оформлено as a written agreement between the spouses on jurisdiction.
How to Formalize an Agreement on Jurisdiction
To use this option, the following steps are required:

Prepare an agreement between the spouses determining the court that will hear the case.

Sign the agreement.

File the divorce claim with the agreed court.
