Check-list for lawyer: purchase an apartment by a foreigner

A lawyer who accompanies the purchase of an apartment (other real estate) in Kyiv / Ukraine must perform the following actions:

1. Get the necessary information and documents from the client according to the questionnaire.
2. Obtain an individual tax number (“TIN“) for a foreigner in Ukraine.
3. Perform a due diligence of the developer of apartment (other real estate) in Kyiv / Ukraine:
   1. Due diligence of the seller:
      1. In the register of Ukrainian lawsuits and Ukrainian courts decisios.
      2. In the Ukrainian register of debtors.
      3. In the Ukrainian register of executive decisions.
   2. Due diligence of the apartment:
      1. In the register of rights to real estate.
      2. In the register of Ukrainian lawsuits and Ukrainian courts decisios.
4. Check the presence of debts on utility bills for an apartment (other real estate) in Kyiv / Ukraine
5. Open a bank account for a foreign buyer in a Ukrainian bank (if necessary).
6. Draft a power of attorney (if necessary).
7. Agree on draft agreements for the purchase of an apartment (other real estate) in Kiev / Ukraine.
8. Inform the client about all expenses (realtor’s fees, taxes and fees).
9. Agree on the time of the transaction with a notary.
10. Accompany the transaction at the notary (paperwork, payment).
11. Control over the receipt by the buyer of the original purchase and sale agreement, extraction from the register of rights to real estate (if applicable) and keys.
12. Report to the chef.
