Lawyers of the “Modus Zilver ” Bar Association represented the interests of the employer company in a labor dispute.
The former employee of the company brought a suitcase to the Holosiivskyi District Court of Kyiv with a claim against the employer with a demand to collect the salary arrears. He argument that the salaries of certain other employees in the relevant period of time were higher than his. At the same time, in accordance with Part 5 of Art. 15 of the Law of Ukraine “On Protection of labor”, managers and specialists of the protection labor services are equal on salary to managers and specialists basic production and technical services. Therefore, plaintiff’s salary had to be no less than the average salary of certain positions at the company.
The lawyers prepared and submitted to the court a number of procedural documents, including and response to the statement of claim. The main task of the lawyers was to prove with which category of positions the plaintiff’s salary should be compared.
As a result of the lawyers efforts parties concluded Settlement, according to which the amount of claims the plaintiff was reduced by approximately 4.5 times.
The settlement agreement in case No. 752/6792/22 was approved by the court.
