Our lawyers helped the director of a Ukrainian LLC to get the court to admit that the labour relationship between the worker (director) and the LLC in connection with his dismissal at his own request was terminated: by a court decision of the Commercial Court of Kyiv in case No. 910/13833/24 the claim was satisfied, the labour relationship was declared terminated.
The prerequisite for such an appeal to the court was the inaction and ignorance of the LLC participant regarding the company’s activities, including failure to hold a general meeting of participants, ignoring the director’s letter of resignation, etc.
In such circumstances, the director can still apply to the commercial court to have the employment relationship recognised as terminated by notice.
