This is why, we have decided to list here the main theses of the Ukrainian legislation as regards the possible ways of purchasing and leasing land in Ukraine by foreigners.
Agricultural land holds particular interest to foreigners. Having said that, this category of land can belong to foreigners exclusively on the basis of the right of land leasehold. Foreigners (including foreign legal entities) are prohibited from purchasing agricultural land plots in Ukraine. In case a foreigner inherits agricultural land, he or she is obliged to alienate this property within a year.
Foreigners have a right to purchase plots of non-agricultural land within settlements as well as plots of non-agricultural land outside settlements where the real estate objects in their private ownership are located. It should be noted that the acquisition of land title can come about on the basis of a sales agreement, lease agreement, deed of gift agreement, contract of exchange, other civil legal agreements, acceptance of an inheritance.
Foreign legal entities can acquire the non-agricultural land title:
а) within settlements in case of purchasing real estate objects or for constructing objects in connection with their entrepreneurial activities in Ukraine;
b) outside settlements in case of purchasing real estate objects.
