A foreign citizen applied to the Zilver Law Firm, who, after customs clearing of his car in the Ukrainian port, discovered that the personal belongings that should have been in the car had disappeared, apparently already at the terminal of destination.
Despite warnings from lawyers that it would be difficult to prove the losses, the client wanted a criminal case to be initiated and the case investigated within the framework of criminal proceedings.
Since the applications about filing information about criminal offence into the relevant register (ERDR) were ignored, lawyers were compelled to apply to the court (link to the decision of the Ilyichevsk City Court of the Odessa Region) to seek the imposition of the obligation on the law enforcement agencies to file information about criminal offence, i.e. in other words, “open a criminal case”.
