Civil case No. 367/15564/25 is currently pending before the Irpin City District Court, in which the claimant is seeking to recover monetary funds from our client.
As the dispute is closely connected with other court proceedings concerning the parties’ corporate rights, our attorney Yevgen Zarudnyev filed a motion to stay the proceedings pursuant to Clause 6, Part 1, Article 251 of the Civil Procedure Code of Ukraine, pending the entry into force of a court decision in another case currently pending before a different court.
Our opponents objected to the stay of the proceedings and insisted on recovering the funds from our client as soon as possible, regardless of the circumstances and outcome of the related court proceedings.
In the view of our legal team, which was supported by the court, the decision in the corporate dispute will be of significant importance for the determination of the claims in case No. 367/15564/25. In these circumstances, proceeding with the civil case before the related corporate dispute is resolved could result in the relevant circumstances being determined without taking into account all legally significant connections between the cases.
The court granted our motion and stayed the proceedings.
This outcome demonstrates the importance of assessing litigation comprehensively, taking into account all relevant circumstances and other court proceedings that may affect the resolution of a particular dispute.
Effective protection of a client’s interests does not always mean seeking to have each case resolved as quickly as possible and independently of other proceedings. In complex corporate and property disputes, it is important to identify the connections between related cases in a timely manner, determine their significance for each proceeding, and properly present the relevant legal position to the court.
