The litigation for the period of almost 3 years in the civil case No. 369/9530/20 was finally closed with the decision as of June 14, 2023 of the Kyiv-Svyatoshynsky District Court of the Kyiv Region.
Within this litigation the lawyers of the Attorneys’ Association “Modus Zilver” filed a statement of defense, a counterclaim, request for expert studying, request for affiant’ hearing etc.
Our lawyers tried to persuade the parties to make a settlement agreement, which lawyers have drafted. As a result, the decision of the court is mostly similar to the recommended settlement agreement.
Deserve to be highlighted following decisions (milestones) of the courts decree:
• a deed of gift of an apartment from a relative to our client was not recognized by the court, as colorable (void);
• all borrowings (such as a payment by installments, as well as bank loan) are divided equally between the parties.
