The client Attorneys association Modus Zilver entered into an agreement with the Leleka maternity hospital. An advance payment was made according to the agreement.
However, due to military operations (in the Kyiv region, since the end of February 2022, medical services in accordance with the agreement have not been provided.
Despite several requests, the Leleka maternity hospital did not return the advance payment received under the contract. It caused necessity to file a lawsuit.
As a result of the consideration of the case in court on September 08, 2023, the Obolonsky District Court of Kiev issued a decree to partially satisfy the claims: the advance amount was collected (minus the cost of insurance), 3% per annum and inflation charges.
