Successfully Defended Client in Inheritance Dispute

A dispute arose in an inheritance case regarding familial relations between the deceased and a potential heir. The latter filed a court application seeking recognition of cohabitation with the deceased as spouses (de facto marital relationship).

Notably, our client — another heir represented and defended by our lawyers — was not notified of this application.

Following a court hearing attended by our legal team, the Shevchenkivskyi District Court of Kyiv dismissed the opposing party’s application without consideration on procedural grounds.

Lawyers from Zilver successfully represented a client who was the defendant in a traffic accident damages compensation case before the Kyiv Court of Appeal.

In the court of first instance, our lawyers secured the termination of proceedings. However, the claimant subsequently filed an appeal.

Our legal team submitted a reasoned response to the appeal and represented the client’s interests during the appellate hearing.

The Court of Appeal upheld the first instance court’s ruling without modifications: the proceedings remain terminated, and our client’s interests have been fully protected.

Commercial Dispute Resolved by Amicable Settlement

The protection of our client’s intellectual property rights was successfully concluded by signing an amicable settlement fully aligned with the client’s interests.

This result was achieved following a set of coordinated legal measures. In particular, the client’s trademark was recorded in the Customs Register of Ukraine, which enabled the customs authorities to block the import of counterfeit goods (the importer had no right to use the protected trademark). In addition, the Commercial Court of Kyiv issued an order securing the claim by prohibiting customs clearance of the relevant goods.

Thanks to the consistent efforts of Zilver Law Firm’s lawyers, these measures prompted the opposing party to initiate negotiations on an amicable resolution of the dispute.

As a result of negotiations conducted with the participation of our lawyers, the parties entered into an amicable settlement, the claim was left without consideration, and the interim measures were lifted.

Customs Clearance of Tons of Cargo Suspended

Once again, our lawyers, acting to protect the intellectual property rights of our clients, have succeeded in suspending the customs clearance of counterfeit imported cargo at the border of Ukraine.

This was preceded by the inclusion of our clients’ trademarks in the special customs register, the submission to the customs authorities of an application to extend the suspension period for the customs clearance of the goods, and the initiation of court proceedings.

As a result, the Commercial Court of the City of Kyiv issued a ruling prohibiting the customs clearance of the goods until the dispute regarding the existence of an infringement of our client’s intellectual property rights is resolved.

The Supreme Court Upheld the Decision

The opposing party of our client first filed appeals with the Kyiv Court of Appeal and subsequently with the Supreme Court against the 2021 decision of the Shevchenkivskyi District Court of Kyiv on the dissolution of marriage. The purpose of these appeals was to annul the divorce four years after it had been granted, which could have significantly affected the rights of relatives of one of the parties.

Our attorneys submitted motions to the Supreme Court, providing arguments as to why the court decisions could not be reviewed for a number of legal reasons.

As a result of the case review, the Supreme Court dismissed the opposing party’s cassation appeal.
